Welcome to Cap VPN. These Terms of Service govern your use of our VPN applications, website, and services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1) Definitions

• App: Cap VPN mobile application distributed via Google Play and the Apple App Store.
• Account: Your Cap VPN identity tied to your platform purchase/subscription.
• Free Plan: No-cost plan with usage limits and ads.
• Premium Plan: Paid subscription with enhanced features and limits removed.

2) Eligibility & Account

• You must be legally capable to enter a binding contract and comply with applicable laws.
• Some features require an Account and a valid platform account for billing.
• You agree to keep your information accurate and secure your device and Account access.

3) Description of the Service

Cap VPN provides a virtual private network connection to help protect privacy and improve connectivity. Cap VPN supports modern protocols including Hysteria2, WireGuard, and VLESS Reality. Actual performance depends on your device, ISP, network conditions, server load, location, and other factors.

4) Plans & Features

4.1 Free Plan

• Time limit: unlimited VPN access.
• Servers: limited server options.
• Ads: Free tier is ad-supported.

4.2 Premium Plan

• Pricing (India): Premium Weekly at ₹129/week and Premium Monthly at ₹199/month via Google Play / Apple App Store. Prices for other regions are shown in-app.
• Unlimited bandwidth, no time limit, zero ads.
• Priority servers, up to 5 simultaneous device connections.
• Features may vary by region and may be updated from time to time.

5) Billing & Payments

• All paid purchases are processed by Google Play Billing or the Apple App Store.
• Subscriptions renew automatically unless cancelled before the next billing cycle.
• To cancel, use your platform subscription settings. Uninstalling the App does not cancel a subscription.
• Refunds are handled per the platform's policies. See our Refund Policy.

6) Fair Use & Acceptable Use

You agree to use the Service lawfully and responsibly. Prohibited activities include:

• Illegal, harmful, infringing, or fraudulent conduct.
• Malware distribution, phishing, spamming, or deceptive practices.
• Unauthorized access, scanning, scraping, or exploiting systems.
• DDoS, botnets, network flooding, or abusive traffic generation.
• Violations of intellectual property rights.
• Distribution of unlawful content.
• Reselling or sharing accounts beyond permitted device limits.

7) Privacy & No-Logs

We maintain a strict no-activity-logs approach. We do not monitor or record your browsing content. We may process minimal connection metadata and aggregated usage needed to operate the Service, as described in our Privacy Policy.

8) Intellectual Property

• We grant you a limited, revocable, non-exclusive license to use the App for personal, lawful purposes.
• All rights, title, and interest in the Service remain with Cap VPN and its licensors.

9) Availability & Changes

• Service availability may vary by region and network conditions.
• We may modify, suspend, or discontinue features or servers at any time.

10) Termination

• We may suspend or terminate access for violations of these Terms or for unlawful activity.
• You may stop using the Service at any time and cancel subscriptions via your platform.

11) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAP VPN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

13) Governing Law

These Terms are governed by the laws of India. Disputes shall first be attempted to be resolved informally by contacting us.

14) Changes to These Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
