Welcome to Cap VPN (“Cap VPN”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our VPN applications, websites, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1) Definitions
- App: Cap VPN Android application distributed via Google Play.
- Account: Your Cap VPN identity tied to your Google Play purchase/subscription.
- Free Plan: Lifetime plan with usage/time limits and ads.
- Premium Plan: Paid subscription with enhanced features and limits removed.
2) Eligibility & Account
- You must be legally capable to enter a binding contract and comply with applicable laws.
- Some features require an Account and a valid Google account to use Google Play Billing.
- You agree to keep your information accurate and secure your device and Account access.
3) Description of the Service
Cap VPN provides a virtual private network connection to help protect privacy and improve connectivity. Cap VPN uses the V2Ray protocol only (no OpenVPN), and may use traffic optimization, routing, and security techniques. Actual performance depends on your device, ISP, network conditions, server load, location, and other factors.
4) Plans & Features
4.1 Free Plan (lifetime)
- Time limit: 2 hours per 24-hour period (as shown in-app).
- Servers: 4+ server options.
- Ads: Free tier is ad-supported.
- Other limitations may apply; features can change over time.
4.2 Premium Plan
- Price (India): ₹350 per month via Google Play Billing (taxes may apply). Prices for other regions are shown in-app.
- Unlimited bandwidth, No time limit, Zero ads.
- 10 Gbps servers (where available), 50+ premium servers, up to 5 devices (as supported in-app).
- Priority support. Features may vary by region and may be updated from time to time.
5) Google Play Billing (Subscriptions & Payments)
- Payment Provider: All paid purchases are processed by Google Play Billing. You authorize Google to charge your selected payment method for recurring subscription fees and applicable taxes.
- Auto-renewal: Subscriptions renew automatically unless you cancel before the next billing cycle. Renewal dates and amounts are shown in your Google Play subscription settings.
- Manage & Cancel: To cancel, pause, or change your plan, go to Google Play app → Payments & subscriptions → Subscriptions → Cap VPN. Uninstalling the App does not cancel a subscription.
- Price Changes: We may update prices and will give notice as required by Google Play policies. If you do not agree, cancel before the change takes effect.
- Refunds: Refunds for purchases made via Google Play are handled per Google Play’s policies and processes. Please request refunds directly through Google Play where applicable. Where permitted by law and platform policy, we may assist but cannot guarantee refunds outside Google Play systems.
6) Trials, Promotions & Credits
Any free trials, introductory pricing, coupons, or credits are subject to specific terms displayed in-app. After a trial, your subscription may auto-renew at the standard price unless you cancel in time.
7) Fair Use & Acceptable Use
You agree to use the Service lawfully and responsibly. Prohibited activities include (without limitation):
- Illegal, harmful, infringing, or fraudulent conduct; evading law enforcement.
- Malware distribution, phishing, spamming, or deceptive practices.
- Attempting unauthorized access, scanning, scraping, or exploiting systems.
- DDoS, botnets, network flooding, or abusive traffic generation.
- Violations of intellectual property rights or DRM/copyright circumvention.
- Distribution of child sexual abuse material or other unlawful content.
- Reselling or sharing accounts beyond permitted device limits.
We may apply network management, session limits, or reasonable measures to protect network integrity and ensure a fair experience for all users.
8) Privacy & No-Logs
We maintain a strict no-activity-logs approach. We do not monitor or record your browsing content. We may process minimal connection metadata and aggregated usage needed to operate and improve the Service (e.g., bandwidth totals, performance metrics), as described in our Privacy Policy. By using the Service, you consent to such processing.
9) App License & Intellectual Property
- We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, lawful purposes.
- All rights, title, and interest in the Service (including software, branding, and content) remain with Cap VPN and its licensors.
- You will not reverse engineer, modify, or create derivative works except to the extent permitted by law.
10) Third-Party Services
The Service may interact with third-party services (e.g., Google Play). Their terms and privacy practices apply in addition to ours.
11) Availability, Updates & Changes
- Service availability may vary by region and network conditions. We may modify, suspend, or discontinue features or servers at any time.
- We may release updates that are required for continued use. Please keep the App updated.
12) Termination
- We may suspend or terminate access immediately for violations of these Terms or for unlawful activity.
- You may stop using the Service at any time, and cancel any paid subscription via Google Play.
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION; OR THAT GEO-UNBLOCKING, SPEEDS, OR SPECIFIC OUTCOMES WILL ALWAYS WORK IN YOUR LOCATION.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAP VPN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REVENUE; ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
15) Indemnification
You agree to defend, indemnify, and hold harmless Cap VPN, its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.
16) Export & Sanctions Compliance
You represent that you are not subject to any applicable sanctions or export restrictions and will not use the Service in violation of such laws.
17) Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflicts of law principles. Where not prohibited by law, you agree to first attempt to resolve disputes informally by contacting us. If unresolved, the dispute may be brought before the competent courts in India, unless mandatory local consumer laws provide otherwise.
18) Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via the App, website, or email. Your continued use after changes become effective constitutes acceptance.
